Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your use of BuildIn AI ("we", "us"), an AI-assisted outdoor design service that turns photos and descriptions of a space into design concepts, component plans, material estimates and construction guidance. By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. Your account

You sign in with an email address and password, or with Google. Your first sign-in with an unknown email creates an account. You are responsible for keeping your credentials secure and for activity under your account. You must be at least 13 years old to use the service.

3. AI-generated content

Design renders and concepts are generated by artificial intelligence from the information you provide. They are illustrative: plants, materials, lighting and dimensions shown in a render are suggestions, not specifications. Renders and estimates may contain errors or omit conditions specific to your site.

4. Construction, safety and permits

BuildIn AI provides planning guidance that supports your project — it does not certify construction safety and is not a substitute for professional engineering or licensed trade work. Structural, electrical, gas, and permit-regulated work may require qualified local professionals and permits. You are responsible for verifying plans against local building codes before you build, and for the safety of any work performed.

5. Pricing and estimates

Some features require payment (for example, garden plans and credit packs). Prices are shown before you purchase. Payments are processed by third-party payment providers; we do not store full payment card numbers. Except where required by law, purchases of digital content are non-refundable once the content has been generated.

Estimates. Cost and material estimates shown in the service are informational estimates based on US retail price ranges and the assumptions listed with each estimate. They are not quotes or offers. They do not include taxes, delivery, permits, labor or local fees, and actual prices are set by third parties and may differ — including due to changes in location, timing, duties, tariffs or regulations. Verify all quantities and prices with your supplier before purchasing.

6. Acceptable use

• Do not use the service for unlawful purposes or to infringe others' rights.
• Do not upload content you do not have the right to use.
• Do not attempt to disrupt, reverse engineer, or abuse the service or its limits.

7. Your content and ours

You keep ownership of the photos and information you upload. You grant us the license needed to process them (including with our AI and infrastructure providers) to provide the service. The service itself — our software, knowledge base, guides, and generated plans for your project — is ours or our licensors' and is provided for your personal or business use in planning your own projects.

8. Disclaimers and liability

The service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Termination

You may stop using the service at any time. We may suspend or terminate accounts that violate these Terms or create risk for other users or for us.

10. Changes

We may update these Terms as the service evolves. Material changes will be announced on this page with a new effective date; continued use after changes means you accept them.

11. Subscriptions and renewal

Yard Care is an auto-renewing subscription. When you subscribe, you agree that it renews automatically at the price and interval shown at purchase (for example, monthly or yearly) and continues until you cancel. We ask for your express agreement to these renewal terms before we collect payment.

You can cancel anytime online in your account (Account → Yard Care), with no cancellation fees. Cancellation takes effect at the end of the period you already paid for, and the service runs until then. We send subscribers a reminder of their renewal terms at least once a year, and where a price change applies, we notify you before it takes effect.

If a paid feature fails to deliver — for example, an AI generation that errors — the charge is refunded automatically. Everything you have already bought stays yours if you cancel: cancelling ends the service, not your plans.

12. Copyright and DMCA

We respect intellectual property rights and expect our users to do the same. If you believe content on our service — including user-shared content, such as photos and renders that owners have chosen to feature in our public galleries — infringes your copyright, send a notice of claimed infringement to our designated copyright agent.

Your notice must comply with the DMCA (17 U.S.C. §512(c)(3)): identify the copyrighted work; identify the infringing material and give enough information to locate it; give your contact details; state your good-faith belief that the use is not authorized; state, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act; and include your signature. We respond by removing or disabling access to the material and notifying the uploader, who may submit a counter-notice. Accounts that repeatedly infringe are terminated.
